Pool fences in Jacksonville

A pool fence is the one fence where the rules are not about looks. Florida law sets a minimum for the barrier around a residential pool, and the gate is where most of the rules live. Get the gate right and the rest is ordinary fence work.

What Florida's pool barrier law says

Section 515.29 of the Florida Statutes sets the barrier rules for residential pools. Three parts matter most for a fence:

  • Florida's residential pool barrier law (section 515.29) requires the barrier to be at least 4 feet high on the outside.
  • It may not have gaps or footholds that a young child could use to crawl under or climb over it.
  • Gates must open outward, away from the pool, close on their own and latch with a self-latching device, with the release on the pool side out of a young child's reach.

Read that middle line again with a picket fence in mind. Picket spacing, the gap at the bottom and horizontal rails a child can use as a ladder all count. That is why most pool fences are vertical aluminum pickets with the rails kept to the pool side or spaced so they do not form steps.

Gates

The gate has to open out, away from the pool, close on its own and latch on its own. A gate that needs a push to latch fails the rule. Hinges and latches wear, so test the gate a few times a year. Open it all the way and let go. It should latch on its own.

Permits and inspection

A pool barrier is often inspected as part of the pool permit, and some cities also want a separate fence permit. Ask your permit office, and ask the fence company whether they have built barriers that passed inspection there. In Jacksonville Beach, note that an oceanfront RS-1 lot is limited to a 3 and a half foot back yard fence, which is shorter than the 4 foot barrier the state requires; that is a question for the city before you design anything.

Questions Jacksonville homeowners ask

How tall does a pool fence have to be in Florida?

At least 4 feet high on the outside, under section 515.29 of the Florida Statutes. Local codes and HOAs can require more, not less.

Can the house wall be part of the pool barrier?

Florida's law does allow a wall of the house to serve as part of the barrier, with extra requirements for doors and windows that open onto the pool area. Ask your permit office how they apply it to your layout.

Do removable mesh pool fences count?

Mesh pool fences are common and can meet the rules when installed to them. Ask the installer to show how the barrier meets section 515.29, and what the permit office in your city accepts.
